01Scope and Applicability

These Terms, together with our Privacy Policy, constitute the entire and sole agreement between you and the Company regarding your access to and use of this Platform. For any questions about your use of the Platform, please contact us at: contact@brihas.ai.

You are permitted to use the Platform if you meet the following criteria:

• You are 18 years of age or older.
• You agree to comply with these Terms of Use and our Privacy Policy.

Services

The Platform is an artificial intelligence-powered conversational system that enables users to interact with AI models through text, voice, images, files, or other supported inputs.

The Platform may:

• Generate automated responses;
• Maintain contextual memory across conversations;
• Store user interaction history;
• Personalise outputs based on prior interactions;
• Learn from interactions and feedback;
• Generate summaries, recommendations, analyses, insights, or conversational responses;
• Provide productivity, informational, educational, wellness, reflection, and support-oriented interactions;
• Generate a quotient based on your interaction with the Platform (the Brihas Quotient);
• Maintain a longitudinal history of your conversations, in accordance with applicable laws.

The Platform is not a human being and all responses are generated through automated systems.

Brihas Quotient

The Brihas Quotient is an AI-generated interpretive score derived from patterns observed in your interactions with the Platform. It is intended to provide reflective insights and self-development guidance. It is not a scientific, clinical, psychological, diagnostic, or psychometric assessment.

It is not:

• An IQ score;
• A psychological diagnosis;
• A mental health assessment;
• A clinical evaluation;
• A personality test validated by a licensed psychologist;
• A measure of intelligence, emotional fitness, employability, suitability, credibility, trustworthiness, or future performance.

The Brihas Quotient is dynamic and may change over time as additional interactions occur. Changes in scores do not necessarily indicate changes in an individual's actual abilities, traits, behaviours, or life outcomes. It must not be used as the sole basis for decisions relating to employment, hiring, promotion, education, admissions, insurance, lending, healthcare, legal matters, eligibility determinations, or any other decision producing significant effects on an individual. These scores are informational in nature and are not used to make decisions that produce legal or similarly significant effects on users.

Brihas Quotient Disclaimer

The Brihas Quotient and any associated dimension scores are AI-generated indicators created from conversational patterns, user interactions, and other information voluntarily provided through the Platform. They are intended solely for personal reflection, self-awareness, and informational purposes.

The Brihas Quotient is not a scientific, medical, psychiatric, psychological, educational, employment, financial, or legal assessment. It is not intended to diagnose any condition, predict future outcomes, determine eligibility, evaluate competence, measure intelligence, or replace professional judgment. The methodology used to generate it may evolve over time and may produce inaccurate, incomplete, inconsistent, or biased results. Users should not rely exclusively on the Brihas Quotient when making important personal, professional, financial, educational, medical, or legal decisions. The Company makes no representation or warranty regarding its accuracy, reliability, validity, predictive value, or fitness for any purpose.

02Licence to Use the Platform

Subject to your compliance with these Terms, the Company grants you a worldwide, non-exclusive, non-transferable, non-sublicensable, revocable, limited licence to access and use the information and services provided on the Platform for your internal use. We may terminate this licence at any time, for any reason, at our sole discretion.

You agree that any breach of these Terms will constitute sufficient grounds for the automatic termination of your licence to use the Platform without prior notice. Upon termination, you must immediately destroy all copies of any materials you have downloaded from the Platform.

You acknowledge that you are granted only a limited licence to use the Platform and that you do not acquire any intellectual property rights in or to the Platform.

We may suspend or terminate your access at any time if:

• You violate these Terms;
• We detect abuse;
• We are required by law;
• We determine continued access presents risk.

Termination does not limit any rights or remedies available to us.

Licence to the Company to process user content: You grant the Company a worldwide, non-exclusive, royalty-free licence to host, store, process, reproduce, and analyse your Input solely for operating, maintaining, improving, and securing the Platform.

03Prohibited Uses

By accessing and using this Platform, you agree that you will not:

1. Use the Platform if you are under the age of 18.
2. Use any content on the Platform in a way that violates any applicable law, rule, or regulation, whether intentionally or unintentionally.
3. Use the Platform in any manner that could adversely affect, impair, disable, infect, or overburden our servers, computer systems, networks, or any other components used to provide the Platform.
4. Interfere with any third party's use and enjoyment of the Platform.
5. Modify or alter any content available on the Platform.
6. Copy, reverse engineer, decompile, or commercially or otherwise reuse any content you may have accessed or downloaded from the Platform, except as expressly permitted.
7. Use any trademarks, logos, or graphics displayed on the Platform without our express written consent.
8. Use the Platform's network or any email addresses obtained from the Platform for advertising, promotional, or marketing campaigns without our prior written consent.
9. Upload any content that infringes upon any third party's intellectual property rights or is obscene, pornographic, blasphemous, libellous, paedophilic, or otherwise illegal or prohibited.

If you are found to be in violation of any of these prohibitions, you agree that the Company may initiate legal proceedings against you.

04Account Creation

To access certain features, you may be required to create an account. You agree to:

• Maintain accurate account information;
• Keep login credentials secure;
• Notify us immediately of unauthorised access;
• Accept responsibility for activities occurring under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or create safety, legal, or operational risks.

05Data Protection and Privacy

You acknowledge that you have read and fully understood the terms of our Privacy Policy, which is published and displayed on the Platform. By using the Platform, you consent to the following as detailed in the Privacy Policy:

1. The types of data being collected by the Company.
2. The purposes for which the data is being collected.
3. The entities that may process the data.

06Intellectual Property

You agree that all services offered, software used, content posted or made available on the Platform, and any other associated functionalities are the intellectual property of the Company. You agree to keep all information pertaining to these confidential at all times.

You further agree not to modify, resell, reuse, licence, distribute, or use our intellectual property in any unauthorised manner. Any use of our intellectual property requires our express written authorisation and consent.

07Trademarks

You agree that all trademarks, logos, and service marks displayed on the Platform are the property of the Company. Any unauthorised use of these is strictly prohibited and may constitute infringement or passing off. Nothing on the Platform should be interpreted as granting any licence or right, whether express or implied, to any individual to use any trademarks belonging to the Company.

08Copyright Notice

All content published or displayed on the Platform is the copyright of the Company. You agree that any form of copying, distribution, or use of such content for any purpose without our express written permission constitutes copyright infringement.

09Third-Party Links

The Platform may contain links to third-party websites or services that are not owned or controlled by the Company. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. The Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

10Cookies and Similar Technologies

We may use cookies, web beacons, and other similar technologies to collect information about your browsing activities and preferences on our Platform. By using our Platform, you consent to our use of these technologies in accordance with our Privacy Policy. You can manage your cookie preferences through your browser settings.

11Disclaimer of Warranties

We do not warrant that:

• Outputs will be correct;
• Outputs will be safe;
• Outputs will meet your expectations;
• Outputs will be legally compliant;
• The Platform will operate without interruption;
• Defects will be corrected.

12Indemnification

You agree to indemnify, defend, and hold harmless the Company and its affiliates, officers, directors, employees, agents, contractors, professionals, and consultants from and against any and all claims, damages, costs, liabilities, and expenses (including, without limitation, reasonable attorneys' fees) arising out of or in connection with: (a) your breach of any applicable law; (b) your illegal or prohibited use of the Platform; (c) your breach of any intellectual property or confidentiality obligations; or (d) your negligence or wilful misconduct.

13Limitation of Liability

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

14General Disclaimers

AI-Generated Content

The Platform uses artificial intelligence to generate responses. AI-generated content may:

• Be inaccurate, incomplete, or outdated;
• Be misleading or contain factual errors;
• Contain hallucinations or fabricated information;
• Reflect biases in training data;
• Misinterpret context or produce inconsistent responses.

You must independently evaluate and verify outputs before relying upon them. The Company shall not be liable for your reliance on the outputs generated by the Platform.

No Professional Advice

The Platform does not provide:

• Medical advice, mental health treatment, therapy, or psychological / psychiatric services;
• Legal, financial, investment, tax, or insurance advice;
• Professional engineering advice;
• Emergency services or crisis intervention services;
• Licensed professional services of any kind.

Any content generated by the Platform is provided solely for informational and general conversational purposes. No physician-patient, therapist-patient, attorney-client, fiduciary, or similar professional relationship is created through use of the Platform.

Medical Disclaimer

The Platform is not a healthcare provider. Information relating to symptoms, diagnoses, medications, treatment options, or health conditions is informational only.

You must not:

• Rely on Platform outputs as medical advice;
• Delay medical treatment based on Platform responses;
• Change medications based solely on Platform outputs;
• Use Platform outputs to diagnose medical conditions.

Always seek advice from qualified healthcare professionals regarding medical concerns. If you believe you may be experiencing a medical emergency, immediately contact emergency services or seek urgent medical attention.

Mental Health and Crisis Disclaimer

The Platform is not a mental health provider, therapist, psychiatrist, psychologist, counsellor, or crisis response service. The Platform cannot assess suicide risk, diagnose mental health conditions, provide psychiatric treatment, deliver emergency intervention, or guarantee user safety.

If you are experiencing emotional distress, suicidal thoughts, self-harm thoughts, or risk of harm to yourself or others, contact emergency services, crisis support services, licensed professionals, or trusted individuals immediately. The Platform must not be relied upon during emergencies or crisis situations.

Longitudinal Memory and Conversation History

The Platform may retain, process, organise, summarise, classify, and utilise historical interactions to provide contextual continuity and personalised experiences. The Platform may store conversation history, user preferences, behavioural patterns, personal information voluntarily provided by users, user-generated content, AI-generated summaries, and inferred contextual information.

The Platform may incorrectly infer, summarise, recall, interpret, or associate information. You acknowledge that memory features may not be perfect, stored information may contain inaccuracies, and personalised outputs may be based on incomplete or incorrect assumptions.

User Content

You may submit prompts, text, images, audio, documents, files, messages, feedback, or other content ("Input"). You represent and warrant that you own or have rights to submit the Input, submission does not violate applicable law, and submission does not infringe intellectual property rights or violate privacy or confidentiality obligations. You remain responsible for your Input.

Outputs

The Platform generates responses, content, suggestions, analyses, recommendations, summaries, and other materials ("Output"). Due to the nature of artificial intelligence, Output may not be unique, similar outputs may be generated for other users, Output may contain errors, and Output may not qualify for intellectual property protection under applicable law. You are solely responsible for evaluating Output before relying on, publishing, distributing, implementing, or using it.

Content Ownership

As between you and the Company, and subject to applicable law, you retain ownership of your Input. Subject to your compliance with these Terms, the Company assigns to you any rights it may have in Output generated specifically for you, to the extent such rights are capable of assignment under applicable law.

The Company retains all rights in the Platform, AI models, algorithms, software, databases, system architecture, safety systems, trained model weights, and underlying intellectual property.

Platform Improvement and AI Training

Subject to our Privacy Policy and applicable law, we may use user interactions, metadata, feedback, safety signals, and usage information to improve the Platform, improve AI systems, train and evaluate models, detect abuse, enhance safety, personalise experiences, and conduct research and analytics. Where required by applicable law, we will obtain necessary consent or provide applicable opt-out mechanisms.

Safety Systems

The Platform may employ automated systems to detect unsafe content, monitor abuse, enforce policies, classify conversations, restrict outputs, escalate safety events, and review content for compliance purposes. We reserve the right to intervene, limit functionality, remove content, or suspend accounts to protect users, the Platform, or third parties.

AI Companion Disclaimer

Users should not assume that the Platform possesses emotions, consciousness, personal experiences, intentions, beliefs, or independent judgment. Any appearance of empathy, affection, friendship, mentorship, or emotional understanding is generated by automated systems.

—Subscriptions, Billing, and Refunds

The Platform may be offered on a free basis and through one or more paid subscription plans. The features, price, and billing cycle of each plan will be described at the point of purchase. By selecting a paid plan, you authorise the Company, or its authorised payment processor, to charge the then-current fees and applicable taxes to your selected payment method.

Paid plans renew automatically at the end of each billing cycle unless cancelled before the renewal date. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing cycle. We will give you advance notice of any change to your fees. Refunds, where offered, will be handled in accordance with our refund policy and applicable law, including the Consumer Protection Act, 2019.

—Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including natural disasters, acts of God, riots, war, epidemics or pandemics, network or power failures, unforeseen internet downtime, hacking, global internet shutdowns, or changes in applicable law.

15Severability

If any provision of these Terms is held to be invalid or unenforceable for any reason, such provision shall be deemed to be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the original intention.

16Governing Law and Jurisdiction

All matters, claims, and any other issues that may arise directly or indirectly from or in connection with these Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The courts located in New Delhi shall have the sole and exclusive jurisdiction to hear all matters, claims, or any such issues arising directly or indirectly from or in connection with these Terms of Use.

17Questions and Grievances

If you have any questions or grievances regarding these Terms of Use, please contact our Grievance Officer. We will acknowledge each grievance within twenty-four (24) hours of receipt and will endeavour to resolve it within fifteen (15) days, or within such timelines as may be prescribed under applicable law.
